A Louisiana small estate affidavit is used to settle the estate of a deceased person (the decedent) while circumventing the court-administered probate process. Known in Louisiana as a “small succession affidavit,” this legal document offers an efficient and cost-effective means of distributing property to one’s heirs following death. Once prepared, the affidavit will be recorded in the parish where land records are maintained.

There are specific requirements that must be adhered to for the estate to qualify as a small succession. Namely, the value of the decedent’s property cannot exceed a certain amount, and the document must be signed by two (2) or more of the decedent’s heirs.
